Enerji korunumu — Emre Can Sepetçi

Fiziğin en sağlam yasalarından biri: enerji ne yoktan var edilir ne de yok edilir; yalnızca bir biçimden ötekine dönüşür. Kinetik enerji ısıya, ısı ışığa... Hiçbir şey kaybolmaz, her şey dönüşür. Hukukta zararla ilgili de benzer, rahatsız edici bir gerçek var: zarar da yok edilemez. Yalnızca biçim ve yer değiştirir.

Silmek değil, dönüştürmek

Tazminat, zararı silmez. Kırılan bacak parayla düzelmez; olan olmuştur. Tazminatın yaptığı, acıyı bir biçimden ötekine çevirmektir — bedensel zararı bir miktar paraya — ve onu bir yerden ötekine taşımaktır: mağdurun sırtından failin hesabına. Ceza da öyle: suçu, faile yüklenen bir acıya dönüştürür. Toplam acı azalmaz; kılık değiştirip yer değiştirir.

Hukuk zararı yok edemez; yalnızca biçimini değiştirip taşır. Tazminat acıyı silmez — onu paraya çevirip mağdurdan faile aktarır. Enerji gibi, zarar da korunur.

"Eski hâle iade" yanılsaması

Hukukun en eski ideallerinden biri restitutio in integrum — her şeyi eski hâline getirmek. Ama tıpkı enerjiyi yok edemediğimiz gibi, olanı da gerçekten geri saramayız. En iyi ihtimalle zararı görünmez kılarız, taşınabilir kılarız, adil biçimde dağıtırız — ama ortadan kaldıramayız. "Eski hâle iade" bir hedeftir; asla tam bir gerçek değil.

Adalet: dağıtım

Belki de bu yüzden adaleti "zararı silme" olarak düşünmek baştan hatalı — imkânsız bir şey istemek olur, enerjiyi yok etmeye çalışmak gibi. Adaletin gerçek işi, dönüşmüş o yükü adil biçimde dağıtmaktır: bu ağırlığı kim taşımalı? Kusurlu olan mı, kusursuz olan mı? Geri dönülmez olanı yok edemeyiz; ama onun yanına bir denge koyabiliriz.

Fizikçi, kapalı bir sistemde toplam enerjinin sabit kaldığını bilir ve hesabını ona göre yapar. Hukukçu da bilmeli: dava kapandığında ortadaki acı sıfırlanmaz; sadece bir hesaptan diğerine geçer. Mesele onu yok etmek değil — doğru hesaba yazabilmek.

One of physics' firmest laws: energy is neither created from nothing nor destroyed; it only transforms from one form to another. Kinetic energy into heat, heat into light... Nothing is lost, everything is transformed. In law, there is a similar, unsettling truth about harm: harm too cannot be destroyed. It only changes form and place.

Not erasing, but transforming

Compensation does not erase harm. A broken leg is not mended by money; what happened has happened. What compensation does is convert the pain from one form to another — bodily harm into a sum of money — and move it from one place to another: off the victim's back and onto the wrongdoer's account. Punishment too: it converts a crime into a suffering laid upon the offender. The total suffering does not decrease; it changes guise and shifts location.

Law cannot destroy harm; it only transforms and moves it. Compensation does not erase the pain — it converts it into money and transfers it from victim to wrongdoer. Like energy, harm is conserved.

The illusion of "restoration"

One of law's oldest ideals is restitutio in integrum — restoring everything to its former state. But just as we cannot destroy energy, we cannot truly rewind what happened. At best we make the harm invisible, make it portable, distribute it justly — but we cannot make it vanish. "Restoration" is a goal; never quite a fact.

Justice: distribution

Perhaps this is why thinking of justice as "erasing harm" is mistaken from the start — it asks for the impossible, like trying to destroy energy. Justice's real work is to distribute justly that transformed weight: who should carry it? The one at fault, or the faultless one? We cannot destroy the irreversible; but we can set a counterweight beside it.

The physicist knows that in a closed system the total energy stays constant, and does the accounting accordingly. The lawyer must know it too: when a case closes, the pain in the room is not zeroed out; it merely passes from one account to another. The point is not to destroy it — but to be able to book it to the right account.
