Gelecek nesillerFuture generations

Mahkemede sesi olmayanlarThose with no voice in court

Every case has parties: a plaintiff, a defendant, perhaps an intervener. But the party some decisions truly affect is not in the room at all — not yet born. The felling of a forest, a climate policy, a nuclear waste: those who will pay the price are the ones who can say nothing to us today. How does law carry the voice of the voiceless?

The majority that cannot vote

Future generations outnumber everyone who has ever existed and everyone alive today — yet they have not a single vote, a single lawyer, a single signature. At the decision table only today's interest speaks; the future's is silent. This is the extreme form of the inequality of arms: one side cannot attend at all. To speak in their name is an agency no one asked of us, but one conscience imposes.

The greatest injustice is set not between those who have a voice today and those who do not; but between those who exist today and those who will pay the price yet are not yet born.

The world as a trust

Perhaps the right concept is not property but trust. A generation does not "own" the world; it takes it from a previous one and hands it to the next. As a given word binds the future, today's decisions bind the not-yet-born — but in reverse: we shape their world in advance, they not ours. This asymmetry is not an ordinary debt but a one-way responsibility.

Responsibility toward the faultless

Future generations have done us no wrong; they can demand nothing of us. Yet we are responsible toward them — just as in strict liability, a burden carried not by the culprit but by the beneficiary. We benefit from today's resource; to leave its cost to them is to create a risk and load its bill onto the back of the innocent. Justice must be built not only among those living at the same time but across time.

Perhaps a civilisation's maturity is measured by its ability to limit its own interest for the sake of someone not yet born who will never thank it. Because true justice reaches not only those who could vote for us, but also those who will never know us.
