Hukukun görünmez ön kabulüLaw's invisible presumption

Hiçbir sözleşme her ihtimali yazamaz. Hiçbir kanun her durumu öngöremez. Öyleyse boşluklar kaçınılmazdır — ve o boşluklarda hukuku ayakta tutan yazılı bir kural değil, sessiz bir varsayımdır: tarafların dürüst davrandığı. Buna iyiniyet denir. Görünmez olduğu için çoğu zaman fark edilmez; ama çekildiği an, bütün yapı çöker.

Yazılmayanı dolduran

Hakkın da bir sınırı var

İyiniyetin en keskin yüzü, hakkı olan birini bile durdurabilmesidir. Bir hakkın varlığı, onu her biçimde kullanma yetkisi vermez; hakkını başkasına zarar vermek için silah yapan kişi, biçimsel olarak haklıyken bile hukukun korumasını yitirir. Çünkü hukuk yalnızca "neye hakkın var?" diye sormaz; "bu hakkı nasıl kullanıyorsun?" diye de sorar. İyiniyet, hakkın kenarına çizilmiş sessiz bir sınırdır.

Güvene dayalı bir bahis

Aslında iyiniyet, bir toplumun kendi üstüne oynadığı bir bahistir: insanların çoğu, çoğu zaman dürüst davranacak. Bu bahis tutmasa, ne ticaret ne komşuluk ne de en basit alışveriş mümkün olurdu. Hukuk, kötü niyetliyi cezalandırırken bile aslında iyiniyetliyi korur — sistemin geri kalanının güvenle işleyebilmesi için.

Belki de olgun bir hukuk düzeninin ölçüsü, ne kadar çok kuralı olduğu değil, kaç kuralı yazmak zorunda kalmadığıdır. İyiniyet ne kadar sağlamsa, hukuk o kadar az konuşmak zorunda kalır. Sessizliğin bu türü, bir güvenin işaretidir.

No contract can write out every contingency. No statute can foresee every situation. So gaps are inevitable — and in those gaps what holds law up is not a written rule but a silent assumption: that the parties act honestly. This is called good faith. Because it is invisible, it usually goes unnoticed; but the moment it is withdrawn, the whole structure collapses.

Filling what is unwritten

A contract is the visible tip of an iceberg; beneath it sits a vast mass of honesty, unwritten but assumed by all. No one writes the clause "I will not deceive you," because that is already the air the contract breathes. Good faith is what speaks where the text falls silent: the invisible ground between the words that makes fidelity to one's word possible. Without it, every contract turns into a chess game between two sides laying traps for each other.

Good faith is the clause written in no contract yet making every contract possible: the assumption that the parties are there not to prey on each other but to build something together.

Even a right has a limit

Good faith's sharpest face is that it can stop even someone who has the right. The existence of a right does not grant the power to exercise it in any manner whatsoever; the one who makes a weapon of their right to harm another loses law's protection even while formally in the right. Because law asks not only "what right do you have?" but also "how are you using this right?" Good faith is a silent limit drawn at the edge of every right.

A wager on trust

Good faith is, in truth, a wager a society makes on itself: most people, most of the time, will act honestly. Were this wager to fail, neither commerce nor neighbourliness nor the simplest transaction would be possible. Even when punishing the bad-faith actor, law is really protecting the good-faith one — so that the rest of the system can run on trust.

Perhaps the measure of a mature legal order is not how many rules it has but how many rules it did not have to write. The stronger good faith is, the less law must speak. This kind of silence is a sign of trust.
