Dosyanın ağırlığı — Emre Can Sepetçi

Masamda bugün yine birkaç dosya var. Dışarıdan bakan biri birkaç yüz sayfa kâğıt görür; ben bir şeyi daha biliyorum: her dosyanın ardında uykusuz bir gece, bir kuşku, birinin hayatının bir eşiği duruyor. Avukatlığın hiç konuşulmayan yanı budur — taşıdığımız şey kâğıt değil, insanların en kırılgan anlarıdır.

Emanet edilen yük

İnsanlar bize en kötü günlerinde gelir. Kimse keyfinden avukata gitmez; bir şey kırıldığında, bir haksızlık çöktüğünde, bir korku büyüdüğünde gelir. Ve gelirken, taşıyamadıkları bir yükü bir süreliğine bizim elimize bırakırlar. Bu bir vekâletten fazlasıdır; bir güven edimidir. O yükü masaya koyduklarında, biraz nefes alırlar — çünkü artık onu yalnız taşımıyorlardır.

İnsanlar bize dosyalarını değil, taşıyamadıkları anları emanet eder. Mesleğin ağırlığı da, onuru da buradadır: başkasının yükünü bir süre omuzlayabilmek.

Mesafe ile şefkat arasında

Bu işin bir dengesi var, hâlâ öğreniyorum. Fazla uzak durursan, dosya bir numaraya döner, karşındaki bir yüz olmaktan çıkar. Fazla yakın durursan, her dosyanın ağırlığı altında ezilir, kimseye faydan kalmaz. Doğru yer, ikisinin arasında bir yerde: insanı görecek kadar yakın, ona yardım edebilecek kadar sağlam durabilmek. Bazı günler bu dengeyi tutturuyorum; bazı günler tutturamıyorum.

Neden hâlâ buradayım

Yorgun olduğum günlerde kendime bunu soruyorum. Cevap, kazanılan davalarda değil — onlar gelir geçer. Cevap, bir müvekkilin omzundan bir yükün kalktığı o an. Birinin, "artık yalnız değilim" dediğini gördüğün an. İnsanların hâlâ taşı değil hukuku seçmesi, bu mesleğe hâlâ bir anlam veriyor.

Akşam dosyaları kapatırken, onların ağırlığını da bırakmayı öğrenmek gerekiyor — yoksa taşınmaz. Ama tümüyle de bırakmamak lazım; o ağırlığı hiç hissetmeyen biri, bu işi yapmamalı. Yarın masada yeni dosyalar olacak. Ve ben, bu ağırlığı taşımaya değer bulduğum sürece, yine burada olacağım.

There are a few files on my desk again today. Someone looking from outside sees a few hundred pages of paper; I know something more: behind each file stands a sleepless night, a doubt, a threshold in someone's life. This is the never-spoken side of being a lawyer — what we carry is not paper but people's most fragile moments.

An entrusted burden

People come to us on their worst days. No one goes to a lawyer for pleasure; they come when something has broken, when an injustice has collapsed on them, when a fear has grown. And in coming, they leave in our hands, for a while, a burden they cannot carry. This is more than an agency; it is an act of trust. When they set that burden on the desk, they breathe a little — because they are no longer carrying it alone.

People entrust to us not their files but the moments they cannot carry. The weight of this profession, and its honour, lie here: being able to shoulder another's burden for a while.

Between distance and tenderness

This work has a balance I am still learning. Stand too far, and the file becomes a number, the person before you ceases to be a face. Stand too close, and you are crushed under the weight of every file, of no use to anyone. The right place is somewhere between the two: close enough to see the person, steady enough to help them. Some days I find this balance; some days I do not.

Why I am still here

On tired days I ask myself this. The answer is not in cases won — those come and go. The answer is that moment when a burden lifts from a client's shoulders. The moment you see someone say, "I am no longer alone." That people still choose law over the stone still gives this profession a meaning.

Closing the files in the evening, one must learn to set down their weight too — otherwise it cannot be carried. But one must not set it down entirely; someone who never feels that weight should not do this work. Tomorrow there will be new files on the desk. And I, as long as I find this weight worth carrying, will be here again.
