Yargı bağımsızlığı, çoğu zaman yanlış anlaşılır: yargıçlara tanınmış bir ayrıcalık sanılır. Oysa o bir ayrıcalık değil, bir güvencedir — ve yargıç için değil, yurttaş içindir. Çünkü korkan bir hâkim, özgürce yargılayamaz.
Korkan hâkim
Bir hâkim işinden, güvenliğinden, yükselmesinden korkuyorsa, kararı vicdanına ve hukuka göre değil, o korkuya göre şekillenir — bilinçli ya da bilinçsiz, gücün büktüğü alana doğru kıvrılır. Bağımsızlık, işte bu kıvrılmayı önlemek için konmuş bir yalıtımdır: hâkimi baskıdan yalıtır ki, önündeki tek ağırlık dosyanın kendi ağırlığı olsun.
Yargı bağımsızlığı yargıcın ayrıcalığı değil, yurttaşın güvencesidir: korkan bir hâkim özgürce yargılayamaz.
Bekçileri kim bekler
"Bekçileri kim bekler?" sorusunun cevabı, tek tek insanların erdemi değil — çünkü erdem kırılgandır ve baskı yeterince ağırsa çoğu kişi eğilir. Cevap, yapıdır: teminat, dokunulmazlık, siyasi misillemeden yalıtım. Bunlar yargıca hizmet etsin diye değil, karşısındakine bir şey borçlu olmayan bir hâkime muhtaç olan davacıya hizmet etsin diye vardır. Bağımsızlık, hâkimin zayıflığına karşı kurulmuş bir zırhtır.
Güce "hayır" diyebilen yer
Bir toplumda yargının bağımsızlığı aşındığında, yurttaş, güç karşısında eşit durabildiği tek yeri kaybeder. Son sığınak çökerse, geriye taşı bırakmış ama karşılığında hiçbir güvence alamamış bir insan kalır. Bağımsız yargı, bir toplumun kendine verdiği sözdür: burada, en güçlüye bile "hayır" denebilir.
Bu yüzden yargı bağımsızlığı bir mesleki imtiyaz tartışması değil, bir özgürlük meselesidir. Aşınması sessiz olur — bir atama, bir korku, bir "acaba" ile başlar; ama kaybı bütünseldir. Çünkü güce "hayır" diyebilen bir yer kalmadığında, geriye yalnızca gücün kendisi kalır. Bir toplumun en değerli görünmez kurumlarından biri budur — ve korunması, herkesin değil ama hepimizin işidir.
Judicial independence is often misunderstood: taken for a privilege granted to judges. But it is not a privilege — it is a guarantee, and not for the judge but for the citizen. Because a frightened judge cannot judge freely.
The frightened judge
If a judge fears for their job, their safety, their advancement, their decision is shaped not by conscience and law but by that fear — consciously or not, it curves toward the field power bends. Independence is an insulation placed to prevent exactly this bending: it insulates the judge from pressure so that the only weight before them is the weight of the file itself.
Judicial independence is not the judge's privilege but the citizen's guarantee: a frightened judge cannot judge freely.
Who guards the guardians
The answer to "who guards the guardians?" is not the virtue of individuals — for virtue is fragile, and if pressure is heavy enough most people bend. The answer is structure: security of tenure, immunity, insulation from political retaliation. These exist not to serve the judge but to serve the litigant who needs a judge that owes nothing to their opponent. Independence is armor built against the judge's own weakness.
The place that can say "no" to power
When the independence of a judiciary erodes in a society, the citizen loses the one place they could stand equal to power. If the last refuge collapses, what remains is a person who set down the stone yet received no guarantee in return. An independent judiciary is a promise a society makes to itself: here, even the most powerful can be told "no."
This is why judicial independence is not a debate about professional privilege but a question of freedom. Its erosion is quiet — it begins with an appointment, a fear, a "what if"; but its loss is total. Because when there is no longer a place that can say "no" to power, all that remains is power itself. This is one of a society's most valuable invisible institutions — and protecting it is the work not of everyone in particular, but of all of us.
